It is a quality process that must transform often incomplete information into a documented, verifiable assessment proportionate to the risk for patients and users.

For manufacturers, importers, and organizations operating throughout the medtech supply chain, the critical challenge is maintaining timeliness, scientific accuracy, and regulatory consistency. A rapid but unvalidated response may generate misleading information. Conversely, an accurate but delayed assessment may postpone the identification of a potential safety or compliance issue. Process clarity is therefore a practical safety measure.

Medical device complaint management: defining the scope

A complaint is any written or verbal communication expressing dissatisfaction regarding the identity, quality, durability, reliability, usability, safety, or performance of a device placed on the market. The report does not need to be expressed in technical language. A usability issue reported by a nurse, a malfunction reported by a distributor, or a comment received through a medical information service may all fall within the scope.

Not every complaint constitutes an incident, and not every incident is automatically serious. Nevertheless, any communication potentially related to safety or performance requires controlled collection and an initial assessment. This makes it possible to distinguish commercial or logistical requests from product nonconformities, events that may trigger vigilance obligations, and signals that warrant trend analysis.

The European regulatory framework, including Regulation (EU) 2017/745 on Medical Devices, requires manufacturers to maintain a post-market surveillance system proportionate to the risk class and appropriate to the type of device. Within this system, complaints represent an essential source of data. ISO 13485 reinforces this approach by requiring documented procedures for feedback and complaint handling, with particular attention to investigation, responsibilities, and record retention.

The internal procedure should therefore clearly define what is classified as a complaint, which minimum information must be collected, who performs triage, when to involve Quality Assurance, Regulatory Affairs, Medical Affairs, or Vigilance functions, and which timelines apply. An ambiguous scope creates the risk of underestimating relevant information or overloading the system with unnecessary activities.

From receipt to closure: a controlled workflow

The process works when every step leaves a trace and when all involved functions work from consistent data. Having a database alone is not sufficient. Classification criteria, formalized roles, updated work instructions, and training for personnel receiving complaints are also required.

Controlled receipt and registration

Upon receipt, the complaint should be recorded using a unique identifier and acquisition date. The original text or description of the complaint, the source channel, and the complainant’s details should be retained in accordance with applicable data protection requirements.

The initial information should, at a minimum, allow identification of the device, batch or serial number where available, context of use, date of the event, country involved, and any clinical outcome. In practice, many complaints are incomplete. For this reason, the intake form or script should guide the operator through targeted questions without suggesting interpretations or assigning causality before technical evaluation.

Triage and preliminary assessment

Triage is intended to determine priority and routing. A labeling issue, cosmetic defect, packaging problem, or suspected malfunction requires different levels of investigation. The initial assessment should also identify indicators such as death, serious deterioration in health, need for clinical intervention, foreseeable misuse, presence of a counterfeit product, or potential contamination.

At this stage, it is essential to distinguish facts reported by the complainant from the company’s own assessments. Documentation should clearly indicate which information has been confirmed, which information is missing, and which follow-up actions have been initiated. If the device is available, procedures for return, chain of custody, and analysis should be defined, particularly when examination of the sample may contribute to the investigation.

Investigation and technical assessment

The investigation cannot be limited to examination of a single unit if the case suggests a broader issue. Depending on the nature of the complaint, the investigation may review batch records, in-process controls, deviations, similar complaints, technical service data, suppliers, design changes, distribution trends, and relevant literature.

The question is not only, “Was the device defective?” but also, “Is there a plausible relationship between the device, instructions for use, user training, operational context, and the reported event?” In some cases, a usability issue may highlight the need to review labeling, instructions for use, or training materials. In others, the available evidence may not be sufficient to confirm a causal relationship. This conclusion must also be justified and supported by the collected data.

Decision, response, and closure

Closure requires a documented decision regarding classification, root cause or most probable cause, potential impact, need for corrective and preventive actions, vigilance obligations, and communication with the complainant. The external response should be accurate, understandable, and consistent with what has actually been established. It should not anticipate unvalidated conclusions or contain inappropriate promotional statements.

A complaint may be closed when the investigation has been completed, necessary actions have been defined, and the documentation has been approved according to the quality system. If a CAPA has been opened, the complaint should not remain indefinitely pending. The record may be closed with a traceable reference to the CAPA, maintaining the link between the complaint, root cause analysis, and effectiveness verification.

When a complaint enters the vigilance system

Reportability assessment is one of the areas with the greatest regulatory impact. A complaint may evolve into an incident and require evaluation for reporting to competent authorities. The decision depends on the type of event, severity of the outcome, role of the device, likelihood of recurrence, and applicable requirements in the relevant markets.

The process should include prompt escalation to Vigilance and Regulatory Affairs functions. Delays often result not from a lack of expertise, but from poorly defined information transfer between the individual receiving the complaint and the individual responsible for the regulatory assessment. A clear escalation pathway with shared urgency criteria reduces this risk.

The relationship with post-market surveillance must also be considered. Individually non-serious complaints may become significant when they reveal a trend, such as an increase in frequency, concentration within a production line, recurrence in a particular use environment, or association with a specific user profile. Periodic analysis of complaint data allows signals to be identified before they develop into widespread issues.

Integrated expertise, reliable data

The quality of complaint management depends on the ability to connect functions that often operate separately. Customer service teams and distributors must know how to recognize and forward a complaint. Quality Assurance must oversee procedures, documentation, and CAPAs. Technical teams must conduct product investigations. Regulatory Affairs and Vigilance teams must evaluate applicable obligations. Medical Affairs and medical writing functions may contribute when clinical context must be interpreted, literature sources reviewed, or scientifically accurate communications prepared.

Outsourcing may be beneficial when volumes fluctuate, multiple markets are involved, or the internal team requires additional specialist support. The advantage lies not in simply transferring activities but in establishing a shared operational model: procedures, escalation matrices, training, service metrics, document control, and periodic case reviews. An external partner should operate as a qualified extension of the organization, with clearly defined responsibilities and controlled access to information.

Eureka InfoMed supports life sciences companies in activities that require scientific rigor, traceability, and operational continuity, integrating expertise in quality, medical information, literature research, and regulatory support. This integration is particularly valuable when a complaint requires a response that is both technically sound and correctly integrated within the quality system.

The best procedure is not necessarily the most complex one. It is the procedure that enables every complaint to reach the right person, with sufficient information, within the required timelines. When the process makes responsibilities, evidence, and decisions visible, complaint management ceases to be a reactive obligation and becomes a tangible source of learning for both the product and the safety of those who use it.

Sources

European Parliament and Council of the European Union. Regulation (EU) 2017/745 on Medical Devices (MDR).

International Organization for Standardization (ISO). ISO 13485:2016 Medical Devices – Quality Management Systems – Requirements for Regulatory Purposes.

European Commission Medical Device Coordination Group (MDCG). MDCG 2023-3 Questions and Answers on Vigilance Terms and Concepts as outlined in Regulation (EU) 2017/745 on Medical Devices.

International Organization for Standardization (ISO). ISO 14971:2019 Medical Devices – Application of Risk Management to Medical Devices.

European Commission Medical Device Coordination Group (MDCG). MDCG 2022-21 Guidance on Periodic Safety Update Report (PSUR) according to Regulation (EU) 2017/745.

European Commission. Medical Device Coordination Group Guidance on Post-Market Surveillance under Regulation (EU) 2017/745.

A complaint concerning a medical device may be received through customer care, a sales representative, a distributor, a healthcare professional, or a digital channel.
